Permit Evaluation
New evaluation service for those who are buying in Poland on their own or with help of local agent.
Our experience shows that many of you trying to buy property in Poland on your own, through family, friends or local agents who are more often not equipped with tools to properly deal with foreigners and asking us for help. We are hearing some horror stories from many customers who were trying to short cut on their own.
Based on new law, from May of 2009 generally foreigners will be able to buy houses and building/recreational plots in Poland without applying for permit to buy.
Unfortunately this law will apply only to some houses and plots with proper planning permission. Other houses and plots , especially in small towns and villages or outside of them very often won’t pass under exception to buy without permit.
The biggest problem will be with farms, smallholdings, bigger plots and many B&B/small hotels. To buy them you will still have to apply for permit to buy until 2016 or to use other legal option to secure that kind of property .
To help you determine if you need permit to buy or have to use other method we are starting new evaluation service.
What we can do for you?
1. Based on a) documents and/or b) checks with local authorities we will evaluate if you need permit or not.
2. If you need permit to buy we will give you contact with English speaking professional, known to us, who will help you to go through it. We will also tell you, approximately: how long it will take to obtain one in your case and how much it will cost or we will give you advice on point 3.
3. We will state other legal options to buy so you can choose the best way to proceed.
You will receive report of it by e-mail or mail (your preference).
Our charges depend on availability of information which you or seller have to supply to us, we need cooperation of your seller or you must have basic information (see below). If seller doesn’t want to disclose that kind of information to you or us usually means there is a legal problem with the property. We will supply you with our questionnaire and list of documents/information needed (in both languages so you can pass it to your seller).
Option one If you/seller will deliver recent (no older than 2 months): 1. copy of property/plot’s registry, so called: “wypis i wyrys”(pol); 2. copy of recent planning permission for the plot; 3. fill out our questionnaire about your ties or prospective ties (business or family) with Poland or lack of it. Your charge will be: £ 300 and your report will be ready in 3, up to 5 working days + delivery time (depends of option). You will have to send £ 300 on our account before we will send you questionnaire and start to work on it so be sure that you can supply necessary information or you will have cooperation of your seller. If you/seller won’t be able to supply us with these recent documents, and we can’t proceed further than we will give you back £150 from £300 (we will keep £150 to reimburse our costs including booking fees, international phone calls, time spent to evaluate available information)
Or Option two: If documents are not recent or incomplete and our representative will have to visit appropriate authorities to obtain them (we still need at least location and registry number of the property/plot), Then it will cost: £800 for properties located in:
* Lower Silesia province,
* Opolskie province
* Lesser Poland province
* Lodz province
* Greater Poland province
* Lubuskie province
For properties located in other Polish provinces, it will cost £1200.
Report in option two will be ready in few weeks time (including waiting period for documents and/or appointments with local authorities), usually between 2-4 weeks.
