So far that kind of information was available only to our clients who have signed an agreement with us but because we can see so much misleading information on other pages about subject matter, we have decided that we must share some of the information with you and save you from unprofessional service. Many businesses, including those well known, tells you that as long as you are EU member, you can buy any kind of property except agricultural land. It is not so, the truth is that you can buy, without permit: - apartments
- premises
- houses – treated as a main residence – you have to show desire to do so, usually applying for resident permit (green card) is the best proof of it – restrictions are as to how much and what type of ground you can buy with the house.
- houses and other buildings for tourists’ related business as long as it is not agricultural land
- garages
Any other property in Poland you should buy/lease through: - applying for permit
- lease with right to buy – in some of the provinces after 3 years, other 7 years (agricultural land and buildings built on it) – if you can show that you are operating agricultural or agro (eco) - tourists' related business yourself through that period of time (land up to 1 ha – if over, lease agreement has to be until may 2016)
- company
To receive permit usually you will have to show bonds with Poland such as : - Polish origin, family relationship
- resident permit
- conducting business in Poland – lately desire to do so is not enough, you need proof
- membership activity in charity org. in Poland
Lease with right to buy option is very good tool to secure, legally, your property until all restrictions will dissolve ( some of them in 2009, rest in 20016 ) but there is a catch to it and sellers are reluctant to sell that way so you need good negotiations to do it, also you need good solicitor who will prepare proper agreement for you (we can book you with English speaking one who usually taking care of our clients, with great success, she can form company for you as well). You will be able to buy, without permit, “second house”, including some plots to build after May of 2009. (Mainly houses in towns or rural on building plots, building and recreational plots) so our commission will be the same like for apartment's buyers (50% lower) as long as you will sign final agreement after May 2009. You will still need permit to buy agricultural land and forest so commission will stay the same for that type of property until 2016. Usually you can secure your desired property few months earlier (before May of 2009) with preliminary agreement and downpayment (10-20% - typical).
Our lawyer's team designed special legal agreement between buyers and sellers which is more acceptable now, for both sides. It will help you to secure second house and some smallholdings before 2009 without applying for permit. - I would like to bring to your attention that around that date experts are predicting high price rise of the properties in Poland because no restrictions means heavy foreign investment, especially German where prices of land are still few times higher than in Poland. - Also already we can see that prices of town and suburb new houses are much lower than apartments in some of the towns (thing unknown on any other property market in Europe) – this factor, together with other (for example: we have seller’s market for now – there is not much to buy around in many areas), will bring next few years enormous price rise of the houses and land but in long term it will bring correction, expected in 5 to 7 years time. Like you can see buying property in Poland differ a lot from buying in UK, Ireland or USA We have to find interested property on the market (which is very difficult and cost and time consuming now) after that check legal requirements to buy (depends of the property) then we have to decide strategy to secure your property, in non expensive, secure and legal way, later on - typical procedure : check title, registry, planning and building permission, than little bit different buying procedure and money exchange as well as transfer issue. Sounds complicated but if you have pro who will “hold your hand” – it is not and it is very profitable if you can secure your property before all restrictions are gone. Generally investing in properties in Poland will give you from 10-30 % per year, very often 50%, there are many reported cases where prices of land in some of the towns and around, as well as waterfront land in some areas have had doubled in one year and waterfront land went up few times in last 3-4 years, some of it from 0,80 PLN per sq m to 40 PLN per sq m and more, and it’s still going because it is still cheaper comparing with rest of Europe. So choice is yours, if you will decide it is worth to invest then please take a pro to help you. You can take some local agent but remember that they are representing mostly local investors, dealing with foreigners only once for a while, also they represent seller’s interest or seller’s and yours so their obligations are not necessarily with you.
